Terms of Service
Last updated: 13 October 2026
1. About these terms
These Terms govern your use of TamashaPass, operated by TamashaPass Limited. TamashaPass is a ticketing platform: we sell tickets on behalf of independent event organizers. The organizer — named on each event page — is responsible for the event itself. By buying a ticket or creating an account you agree to these Terms and our Privacy Policy.
2. Buying tickets
- Prices are shown in Kenya Shillings (KES). Your order is confirmed only once M-Pesa confirms your payment and we issue your tickets.
- Seats are held for a short time while you complete payment. If payment is not completed, the seats are released.
- Your tickets are emailed to you and are also available on your private ticket page. Please check your email address carefully before paying.
- Each ticket has a unique QR code that admits one person and can be scanned only once. Keep your codes private; we are not responsible for entry refused because someone else used your code first.
- Organizers may set entry conditions such as age limits, ID checks, dress codes and security searches. Entry may be refused if you do not meet them.
- Reselling tickets for profit or buying them using automated tools is not allowed, and such tickets may be cancelled.
3. Refunds, cancellations and changes
Tickets are generally non-refundable except where the event is cancelled, or where the organizer's refund policy or applicable law provides otherwise. If an event is cancelled, the organizer is responsible for refunds and we will help facilitate them. If an event is postponed or materially changed, we will notify you using the contact details on your order. To request help with a refund, contact us with your order reference.
4. Payments
Payments are processed through Safaricom M-Pesa. You authorise the payment on your own phone with your M-Pesa PIN. If money is deducted but you do not receive your tickets within a few minutes, contact us with your M-Pesa receipt number and we will resolve it.
5. Organizer terms
- You must provide accurate event information and keep it up to date, and you must have the right to hold the event and sell tickets for it.
- Listing events is free. A service fee (shown in your dashboard) is deducted from paid ticket sales. Free events carry no fee.
- Payouts are made to your registered payout details after deduction of fees, in line with the payout schedule we agree with you. We may hold payouts where there is a risk of fraud, chargeback or cancellation.
- You are responsible for delivering the event as advertised, for refunds if the event is cancelled or materially changed, and for any permits, licences and taxes relating to your event.
- You must handle attendee data in line with the Data Protection Act, 2019 — use it only for your event, keep it secure, and do not send marketing to attendees without their consent.
- You may not list events that are illegal, misleading, hateful or that endanger attendees. We may remove events or suspend accounts that break these Terms.
6. Liability
We provide the platform "as is". To the extent permitted by law, TamashaPass is not liable for the conduct of organizers or attendees, or for the content, quality, safety or cancellation of any event. Nothing in these Terms limits rights you have under the Consumer Protection Act, 2012 or other Kenyan law that cannot be excluded.
7. Governing law
These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.
